Welcome to Solitude & Co. By accessing or using our website and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.

 

1. Services Provided

Solitude & Co. specializes in glamour, performing arts, boudoir, event, and content creator photography and videography. Our services include, but are not limited to, photography sessions, image editing, and delivery of final photographic products.

 

2. Booking and Payment

Booking: To book a session, you must contact us via our website, email, or phone. A booking is confirmed only when a non-refundable deposit is received.
Payment: Full payment must be made by the due date as outlined on the invoice. We accept payments via PayPal, direct transfer or credit card.
Cancellations: Cancellations made less than 24 hours before the scheduled session will forfeit the deposit. Rescheduling is allowed subject to availability.

3. Client Responsibilities

Timeliness: Clients must arrive on time for their scheduled session. Late arrivals may result in reduced session time or rescheduling.
Preparation: Clients are responsible for their own preparation, including outfits, makeup, and props unless otherwise agreed upon.

4. Copyright and Usage Rights

Photographer's Rights: Solitude & Co. retains the copyright to all images captured during the session. We reserve the right to use these images for our portfolio, website, social media, and marketing materials. The images selected will not contain any explicit and/or adult material, and would be in compliance with the relative Terms of Use by the nominated website/social media platform.
Client's Rights: Clients receive a license to use the delivered images for personal use. Commercial use or redistribution of images is prohibited without written consent from Solitude & Co.
Model Release: By booking a session, clients grant Solitude & Co. permission to use their likeness in the captured images for promotional purposes.

5. Image Delivery and Editing

Delivery: Final edited images will be delivered within 6 weeks after the session. Delivery methods include digital download or physical media as agreed upon.
Editing: Basic editing is included in the session fee. Additional editing requests may incur extra charges.

6. Limitation of Liability

Solitude & Co. is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our liability for any direct damages shall be limited to the amount paid for the session.

 

7. Force Majeure

Solitude & Co. is not liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to natural disasters, war, strikes, or government restrictions.

 

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of South Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of South Australia.

 

9. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any changes by posting the new terms on our website. Your continued use of our services after any changes constitutes acceptance of the new terms.
